Couchbase ConnectONLINE 2021 Hackathon Terms and Conditions

Thank you for your interest in the Couchbase ConnectONLINE 2021 Hackathon (“Hackathon”).

BY REGISTERING FOR THE HACKATHON, PARTICIPATING OR ATTEMPTING TO PARTICIPATE IN THE HACKATHON AND/OR USING THE HACKATHON SITE (“Site”), YOU (“you” or “Participant”) ARE AGREEING TO THESE TERMS AND CONDITIONS (“Terms”). THESE TERMS ARE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND COUCHBASE, INC. (“Couchbase”) WITH RESPECT TO THE HACKATHON. THE HACKATHON IS VOID WHERE PROHIBITED BY LAW. Couchbase shall have the right to modify these Terms and Conditions at any time, which modification shall be effective immediately upon posting. Accordingly, we suggest that you check this page periodically. Additionally, Couchbase reserves the right, in its sole discretion, to cancel, modify or suspend the Hackathon in whole or in part.

The Hackathon is being held in connection with the ConnectONLINE 2021 conference (the “Event”). If you register for or participate at the Event, your registration and participation will be governed by the separate terms and conditions that apply to such Event. Please visit our website at https://connect.couchbase.com for details about the Event and a copy of such terms.

When is the Hackathon?

The Hackathon begins September 16, 2021 and ends on October 14, 2021 at 11:59 p.m. Pacific Time (the “Deadline”). Eligible Entries must be submitted to Couchbase by the Deadline. The Hackathon will be held virtually. As this is a virtual event, you are responsible with all costs associated with your participation in the Hackathon and for obtaining whatever hardware and/or software you use to participate.

Who is eligible to participate?

To be eligible to participate in the Hackathon (a “Participant”), you must be (i) an adult at least 18 years old who is legally able to enter into a contract; (ii) allowed to participate in the Hackathon under the rules of your employment; and (iii) not otherwise disqualified under these Terms.

An Entry must be a submission by a single Participant, and you may not submit an Entry as a team with any other Participants as part of the Hackathon.

Each Entry must be original, created by the Participant and cannot in any way copy software code that already privately or publicly exists. Entries may be subject to a due diligence review at any time for eligibility and compliance with these Terms. Couchbase in its sole discretion will determine Entries’ eligibility and Couchbase reserves the right to disqualify any Entry if the Entry or Participant does not comply with these Terms.

By submitting an Entry, you represent and warrant that the Entry is and will be your own original work and does not and will not infringe the intellectual property or proprietary rights of any third party, including, without limitation, any third party patents, copyrights or trademarks.

Who is not eligible to participate?

The following categories of individuals are not eligible to participate in the Hackathon:

(i) employees of Couchbase and its affiliates or individuals providing services to Couchbase through an outsourcer or temporary employment agency during the Hackathon period, and their respective immediate family members and persons living in their same household; (ii) foreign officials (as defined under the U.S. Foreign Corrupt Practices Act (FCPA) and other similar laws) and government employees; (iii) any individual judging the Hackathon; (iv) and any other individual or organization whose participation in the Hackathon would create, in the sole discretion of Couchbase, a real or apparent conflict of interest.

How do I register?

To register to be a Participant in the Hackathon, you must register in connection with submitting your Entry and agree to these Terms and acknowledge the Couchbase Privacy Policy (“Privacy Policy”). You will need to provide certain information about yourself to register. Registrations are limited and are on a first come, first serve basis, and Couchbase has the right to end registration or limit the number of registrants at any time in its discretion. You may register at any time before the Deadline.

What must I submit?

A Participant may only submit one video and associated public code repository and information in English (collectively, the “Entry”). Incomplete entries may be disqualified. Entries must include a video that is five (5) minutes in duration or less and in .mp4 format. The public code repository must run against an empty Couchbase Docker Image (using Couchbase 7 Enterprise or Community Edition with Collections). The Entry must include a link to a public repo of the code. The Entry must include functioning software that uses any Couchbase developer tool or software. Any supported Couchbase SDK can be used. Entries must be submitted to Couchbase via a Google Drive folder or other submission method as chosen by Couchbase by the Deadline.

Once you have entered the Entry to Couchbase, you may not make any changes or alterations to the Entry.

Couchbase must be able to evaluate and test the Entry without proprietary or third party hardware.

How will winners be determined?

Couchbase in its sole discretion will evaluate Entries to determine one (1) winner in each of two (2) categories: “Best Overall” and “Best Use of Couchbase Technology.” The determination of the winner of the “Best Overall” category will be based upon the following criteria:

  1. Innovativeness: How unique or different and innovative is the Entry? This includes with respect to the use of Couchbase products, including SDKs.
  2. Technical: How technically sophisticated/advanced is the Entry? Does the Entry approach the solution with elegance and clean code?
  3. Business Value and Impact: How impactful is the Entry? Does it have business value?
  4. UX/UI: How does the Entry use interfaces (including an API, developer tool, or Fullstack application) to access, work with or interact with the relevant code?

With respect to the two categories as evaluated by Couchbase, the Entries that earn the highest overall scores will win. The decisions of the Couchbase judges will be final, and in the event of a tie, the judges will deliberate to determine the winner.

One (1) winner of an additional category, “Most Popular,” will be determined by a virtual poll conducted by Couchbase of all attendees at the Event, pursuant to the process selected by Couchbase.

A single Entry may not win multiple prizes. If a single Entry is selected to win multiple prizes, it shall only be eligible for the higher-value prize, and Couchbase shall in its sole discretion confirm the eligibility of the next most eligible Entry to win in the remaining categor(ies).

Winners will be announced during the Event.

What are the prizes?

The prizes will be awarded as follows:

  1. $600 prize for the winner of “Best Overall” category;
  2. $500 prize for the winner of the “Best Use of Couchbase Technology” category; and
  3. $400 prize for the “Most Popular” category.

The odds of winning depend on the total number of eligible Entries received. No cash or other substitution of prizes is permitted, except at the sole option of Couchbase for a prize of equal or greater value. Couchbase will not replace any lost or stolen prizes. Winners are solely responsible for any and all federal, state, provincial and local taxes, if any, that apply to prizes. Approximate value of the prize: up to $600(U.S.).

Couchbase will determine participation eligibility, declare winners and award prizes in its sole and absolute discretion. By participating in the Hackathon, you agree that such decisions are final and are not subject to review or reconsideration. Winners may be required to sign and return an affidavit of eligibility and publicity/liability release within seven (7) days of notification and if applicable will be issued a W-9 tax form. WITHOUT LIMITING THE GENERAL NATURE OF THE PRIOR SENTENCE, AWARDS OF PRIZES TO WINNERS ARE SUBJECT TO THE EXPRESS REQUIREMENT THAT THEY SUBMIT TO COUCHBASE ALL DOCUMENTATION REQUESTED BY IT TO PERMIT IT TO COMPLY WITH ALL APPLICABLE STATE, FEDERAL AND LOCAL TAX REPORTING. ALL PRIZES WILL BE NET OF ANY TAXES REQUIRED BY LAW TO BE WITHHELD. TO THE EXTENT PERMITTED BY LAW, ALL TAXES IMPOSED ON PRIZES ARE THE SOLE RESPONSIBILITY OF WINNERS. If a selected winner cannot be contacted, is ineligible, fails to claim a prize and/or where applicable an affidavit of eligibility and publicity/liability release is not timely received, is incomplete or modified, the prize may be forfeited and an alternate winner will be selected from remaining valid, eligible Entries timely submitted.

Couchbase shall not, in any way, be responsible or liable for such distributions or any actions or inactions relating to such distributions. Except as stated above, Prizes awarded are non-transferable. Non-cash prizes, if any, are not exchangeable for cash. The ability to offer and provide, and for any Participant to receive, any prize(s) are subject to applicable laws and regulations and to availability.

How will Couchbase use my information?

By accepting the Terms or participating in the Hackathon, you acknowledge and agree that Couchbase may use the Hackathon for publicity, advertising or other marketing purposes in any media. Couchbase (and/or others on behalf of us) may be photographing, recording (both audio and video), live streaming, webcasting and or otherwise transmitting audio and video during the Hackathon. Your name, avatar, image, likeness, voice, statements and any other identifying characteristics (each, an “Image”) may be captured and you hereby consent that we may record, film, photograph, capture and use your Image, in each case in accordance with the Privacy Policy. You grant to us and our affiliates, agents, employees and assigns an irrevocable, nonexclusive, perpetual, worldwide, royalty-free right and license to use, reproduce, modify, distribute, and translate, for any purpose relating to our business, all or any part of your Images.

What license does Couchbase have to my Entry?

You hereby grant Couchbase a non-exclusive, sublicensable, worldwide right and license to copy, edit, publicly display, publicly perform, broadcast, publish and use, in whole or in part, any Entry, in any manner without further compensation during and after the Hackathon.

Are there any other rules and terms for the Hackathon?
  • You hereby agree not to instigate, support, maintain or authorize any action, claim or lawsuit against Couchbase, or any other person, on the grounds that any use of a Participant’s Entry, infringes any of Participant’s rights as creator of the Entry, including, without limitation, trademark rights, copyrights and moral rights or “droit moral.”
  • Nothing herein shall constitute an employment, joint venture, or partnership relationship between you and Couchbase. Participants will not receive any compensation from Couchbase in connection with any Entries. Each Participant acknowledges and agrees that Couchbase or other Participants or third parties may have developed or commissioned works which are similar to the Entry of Participant, or may develop something similar in the future, and each Participant waives any claims that Participant may have resulting from any similarities to the Entry of Participant.
  • You may not interfere with the progress of any other Participant.
  • You may not: use, or incorporate into the hacks any inappropriate or unlawful content; take any action in violation of applicable laws or regulations; provide information or materials about another person without appropriate authority or permission; interfere with, remove or modify any terms and conditions, content or other materials posted on the Site or other websites associated with the Hackathon or Event; attempt to collect or solicit information about other Participants or third parties without their consent; or send unsolicited mail, advertisements, or other similar promotional material using any websites associated with the Hackathon or Event.
  • The Site and the Hackathon are based in the United States and intended only for the use of those who may legally access the Site and participate in the Hackathon under relevant U.S. laws and regulations (including but not limited to U.S. export control laws and regulations and/or sanctions administered by the Office of Foreign Assets Control). You agree to use this Site and participate in the Hackathon in compliance with any and all applicable laws and regulations. You may not use the Site or participate in the Hackathon for any unlawful purpose or engage in any conduct which restricts others from enjoying the Site or participating in the Hackathon. Couchbase reserves the right to expel any individual from the Hackathon if the individual is not authorized to participate in the Hackathon, is violating any rules or restrictions of the premises where the Hackathon is being held, is violating these Terms, and/or is otherwise disruptive or engaging in activities detrimental to the conduct of the Hackathon, all as determined by Couchbase in its sole discretion.
  • Content on the Site and linked pages include materials of Couchbase and/or its content providers. Couchbase and its relevant content providers reserve any and all of their respective rights in such materials. You are authorized to access and use such materials solely with respect to registration for and/or participation in the Hackathon. You may not use the Site or any materials on it for any unauthorized purpose. All rights not specifically granted are reserved.
  • The Site, the Hackathon, and these Terms are governed by the laws of the State of California. Any claims or disputes relating to the Site, the Hackathon and/or these Terms must be settled exclusively in the federal or state courts located in San Mateo County, California.
  • To the maximum extent permitted under applicable law, Couchbase, its directors, officers, employees, agents, representatives, vendors, contractors, content partners and Couchbase (collectively, “Indemnitees”) shall not be liable for any damages, losses or claims resulting from any person’s participation (or attempted participation) in the Hackathon and/or this Site. To the maximum extent permitted under applicable law, Indemnitees are not responsible for technical problems or technical malfunction or other occurrences which may affect the operation of the Site or the Hackathon, including but not limited to: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; failure of any email or website transmissions to be sent to or received; inaccessibility of any third party service being used in connection with the Site or the Hackathon (including but not limited to any third party websites or Internet service providers); traffic congestions on the Internet or the Site; and/or inaccessibility or unavailability of an email account, app or other item used or desired to be used in connection with the Hackathon or this Site). To the maximum extent permitted under applicable law, all Participants and any other individuals using this Site and/or attempting to participate in the Hackathon hereby release the Indemnitees from any and all claims, damages or liabilities arising from or relating to their participation or attempted participation in the Hackathon and/or this Site.
  • This Site and the Hackathon are made available on an AS-IS, WHERE IS, and any and all express or implied warranties or duties are hereby disclaimed. Couchbase can discontinue the Site and/or the Hackathon, or suspend or postpone the Hackathon, at any time in its sole discretion. IN NO EVENT WILL THE INDEMNITEES BE LIABLE TO YOU FOR ANY DIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE HACKATHON, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT SPONSORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.
  • The Hackathon is subject to federal, state, and local laws and regulations. The Hackathon is offered by Couchbase, which is not responsible for (i) late, lost, damaged, incomplete, or misdirected Entries, responses, or other correspondence, whether by email or postal mail or otherwise; (ii) theft, destruction, unauthorized access to or alterations of Entries; or (iii) phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties.
  • This Site may include links to third-party sites which are not under the control of Couchbase. Couchbase is not responsible for the content or operation of such sites, which may have their own terms. The inclusion of a link to a third-party site does not imply endorsement by Couchbase.
  • To the maximum extent permitted under applicable law, you agree to indemnify and hold harmless Indemnitees from and against any and all claims, suits, actions, losses, expenses, damages, penalties, and costs, including reasonable attorneys’ fees resulting from any actual or alleged violation of these Terms by you, use of the site by you and/or your participation in the Hackathon.
  • If any portion of this these Terms is determined by any court or governmental agency of competent jurisdiction to violate applicable law or otherwise not to conform to requirements of law, then the rest of these Terms will remain in effect and the parties will substitute a suitable and equitable provision for the invalid/unenforceable provision in order to carry out the original intent and purpose of the original Terms. Couchbase’s failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
  • You may not assign, delegate or transfer your registration for the Hackathon and/or any of your rights or obligations under these Terms. Any attempted assignment, delegation or transfer shall be void.
  • These Terms (which, for clarification, includes the Privacy Policy and all other terms incorporated by reference into these Terms), together with any Hackathon registration represent your entire agreement with Couchbase with respect to the Hackathon. These terms cannot be modified or changed except with the written agreement of Couchbase.

ConnectONLINE 2021 | Developer Hackathon

This year we’re hosting the very first ConnectONLINE Hackathon, and you’re invited to join the fun! Show off your development skills by building any full app, API, or tool you can imagine – as long as you develop it using Couchbase with our SDKs. Then showcase your project in a 5-minute video and you could win a big cash money prize (plus the praise of your peers).

  2. Best Use of Couchbase Tech – $500
  3. Most Popular – $400

How to enter:

  • Fill out the form on the right with your contact info and a link to a public GitHub repo of your code
  • Title your video and drop it in our Hackathon folder on Google Drive by October 1 (link provided once you submit)
  • Remind your friends to register for ConnectONLINE so they can vote for your project!

Requirements for valid submission:

You can use any supported Couchbase SDK to build your project, and the code must run against an empty Couchbase Docker image (using Couchbase 7 Enterprise or Community Edition with collections). In your entry form, be sure to include a link to a public GitHub repo of your project code. Your demo video of the project must be 5 minutes or less in duration, 1920x1080 resolution, and in MP4 format. Please note, you must add your video to our Hackathon folder in Google Drive by October 1 to participate in the contest. If you need help uploading your video, please reach out to [email protected] for assistance. We reserve the right to use your name and video for Couchbase promotional purposes. Only one submission per person will be accepted.

Eligibility:

  • Individuals must be 18 years or older to enter.
  • We welcome worldwide entries, however, individuals or organizations may be disqualified if they are based in a nation, state, province, or territory where U.S. or local law prohibits participating in the competition or receiving a prize (including, but not limited to, Brazil, Quebec, Cuba, Sudan, Iran, North Korea, Syria, and any other country designated by the United States Treasury's Office of Foreign Assets Control).
  • Couchbase employees are not eligible.
